ITS Group Information Technology.
LICENSE AGREEMENT
This is a legal agreement between you (either an individual or
entity) and ITS Group Information Technology.. By
downloading or opening software files in any form you are
agreeing to be bound by the terms of this agreement. The
intent of this license is to establish a protocol to
distribute and change the software regulated by this license
under the open source model.
This license applies to any software containing a notice
placed by the copyright holder saying that it may be
distributed under the terms of the ITS Group Information Technology
Publications Inc. License Agreement. Such application is
herein referred to as the Software. This license covers
modification and distribution of the Software, use of
third-party application programs based on the Software, and
development of software which uses the Software.
Granted Rights
You are granted the non-exclusive rights set forth in this
license provided you agree to and comply with any and all
conditions in this license. Whole or partial distribution of
the Software, or software items that link with the Software,
in any form signifies acceptance of this license.
ITS Group Information Technology. (ITsGroup) grants you the right to
use one copy of JOBBANK Job Board software program included
with this distribution method on a single server.
Under each license you may copy and distribute the Software in
unmodified form provided that the entire package, including -
but not restricted to - copyright, trademark notices and
disclaimers, as released by ITsGroup, is
distributed and payment is remitted to ITS Group Information Technology
Publications Inc. for each license that is distributed.
Payment shall be the cost of the open source application at
that time.
You may make modifications to the Software and distribute your
modifications, in a form that is separate from the Software.
The following restrictions apply to modifications:
a. Modifications must not alter or remove any copyright
notices in the Software.
b. When modifications to the Software are released or
distributed under this license, a separate license must be
purchased from ITS Group Information Technology., in
accordance with paragraph (2) above.
The following is acceptable for a Single License on a Single
Web Server:
a. You may distribute machine-executable forms of the Software
or machine-executable forms of modified versions of the
Software.
b. You may use the original or modified versions of the
Software to compile, link and run application programs legally
developed by you or by others.
c. You may develop application programs, reusable components
and other software items that link with the original or
modified versions of the Software.
Limitations of Liability
EXCEPT AS EXPRESSLY SET FORTH IN THIS
AGREEMENT, NEITHER RECIPIENT NOR ANY CONTRIBUTORS SHALL HAVE
ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL,
EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING WITHOUT
LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF
LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT
(INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY
OUT OF THE USE OR DISTRIBUTION OF THE PROGRAM OR THE EXERCISE
OF ANY RIGHTS GRANTED HEREUNDER, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
No Warranty
EXCEPT AS EXPRESSLY SET
FORTH IN THIS AGREEMENT, THE PROGRAM IS PROVIDED ON AN "AS IS"
BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER
EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY
WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT,
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Each Recipient is solely responsible for
determining the appropriateness of using and distributing the
Program and assumes all risks associated with its exercise of
rights under this Agreement, including but not limited to the
risks and costs of program errors, compliance with applicable
laws, damage to or loss of data, programs or equipment, and
unavailability or interruption of operations.
